These Terms and Conditions ("Terms") govern your use of the website at rattanac.site and any services provided by Rattana Counsel ("we", "us", "our"), a legal practice registered in Bangkok, Thailand. Please read these Terms carefully before engaging our services or using this website.

1. Definitions

  • "Agreement" means these Terms, together with any engagement letter or service agreement we issue to you.
  • "Client" / "You" means the individual or entity engaging our services or using this website.
  • "Services" means the legal services described on this website, including will drafting and notarization, estate planning consultation, and comprehensive estate plan preparation.
  • "Website" means the website operated by Rattana Counsel at rattanac.site.
  • "Documents" means any written work product, draft, or final document we prepare in connection with your matter.

2. Acceptance of Terms

By using this website or engaging our services, you confirm that you have read and agree to these Terms. If you are engaging us on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. Our services are available to individuals aged 18 and over only. If you do not agree to these Terms, please do not use this website or engage our services.

3. Description of Services

Rattana Counsel provides inheritance legal services in Thailand, including:

  • Will drafting and notarization under Thai law
  • Estate planning consultations with a written summary
  • Comprehensive estate plan preparation for clients with complex or multi-jurisdictional estate arrangements

The precise scope of any engagement will be confirmed in a separate engagement letter. Services are primarily provided in Bangkok and are governed by Thai law. We do not provide legal advice under the laws of any jurisdiction other than Thailand, though we may assist in coordinating with qualified legal professionals in other countries where this is required for your matter.

4. Client Responsibilities

To enable us to carry out your matter effectively, you agree to:

  • Provide accurate, complete, and timely information and instructions as we reasonably request
  • Promptly review and respond to any documents or queries we send to you
  • Notify us of any change in your circumstances that may be relevant to the matter
  • Not provide false or misleading information in connection with any matter or your use of this website
  • Comply with all applicable laws in connection with the subject matter of your instructions

5. Fees and Payment

Service fees are as set out on our website and confirmed in the engagement letter for your matter. All fees are quoted in Thai Baht (฿) and are inclusive of applicable taxes unless otherwise stated.

  • Payment terms will be confirmed in your engagement letter; typically, a deposit is required before work commences
  • We accept payment by bank transfer to our designated Thai bank account
  • Fees paid for a consultation that has taken place are not refundable
  • For comprehensive estate work, fees are staged and refund arrangements for work not yet commenced will be addressed in the engagement letter
  • Disbursements (such as notarization fees or official fees) are charged at cost and are payable in addition to professional fees

Where a matter is terminated before completion for reasons beyond our control, fees for work completed to the point of termination will be payable.

6. Confidentiality

We treat all information you share with us in the course of your matter as confidential. We will not disclose your personal or matter information to third parties except where necessary to carry out your instructions, where required by law or a court order, or with your explicit consent. Our confidentiality obligations are subject to any overriding legal duty of disclosure.

7. Intellectual Property

All content on this website, including text, design, and structure, is the property of Rattana Counsel and is protected by applicable intellectual property law. You may view and print website content for personal, non-commercial reference only. Documents we prepare for your matter are provided for your personal legal use and may not be reproduced or used for any other purpose without our written consent.

8. Disclaimers

The information published on this website is provided for general informational purposes and does not constitute legal advice. You should not rely on website content as a substitute for specific legal advice on your individual circumstances.

Legal outcomes depend on the specific facts and circumstances of each matter and applicable law. We make no representation that any particular outcome will be achieved in your matter. 9. Limitation of Liability

To the extent permitted by applicable law, our total liability to you in connection with any matter shall not exceed the fees paid by you for that specific matter. We are not liable for any indirect, consequential, or special loss or damage arising from or in connection with our services or your use of this website, including loss of business, loss of anticipated savings, or loss of data.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable Thai law, including liability for fraud or willful misconduct.

10. Indemnification

You agree to indemnify and hold Rattana Counsel and its qualified counsel harmless from any claims, damages, or costs (including reasonable legal fees) arising from your breach of these Terms, your provision of inaccurate information, or your use of our services in a manner contrary to applicable law.

11. Termination

Either party may terminate an engagement by written notice. We may decline to continue acting where there is a conflict of interest, where you have not complied with your obligations under these Terms or the engagement letter, or where continued engagement would require us to act contrary to our professional obligations. Upon termination, you remain liable for fees for work completed to that point.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from or in connection with these Terms or your engagement with Rattana Counsel shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

Where a dispute arises, we ask that you first contact us directly to seek an informal resolution. Most matters can be addressed through direct correspondence. We reserve the right to refer unresolved disputes to mediation before commencing court proceedings.

13. General Provisions

  • Entire Agreement: These Terms, together with the engagement letter for your matter, constitute the entire agreement between us in relation to your matter.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any right under these Terms does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under an engagement without our written consent. We may transfer our obligations to qualified successors in a firm restructuring.

14. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on this website. Changes take effect from the date of publication. Your continued use of our website or services after any update constitutes your acceptance of the revised Terms. For matters already underway, changes to these Terms do not affect the agreed terms of your existing engagement unless we give you written notice.
