Questions & Answers

Matters Clients Often Ask About

Do I need a Thai will if I already have a will in my home country? +

A foreign will may be recognised in Thailand under certain conditions, but the process for enforcing it through Thai courts can be lengthy and uncertain. For property or assets located in Thailand, a separate Thai will is generally the more reliable arrangement. We can review your existing will and advise on what additional steps, if any, would be appropriate.

What happens to property in Thailand if there is no will? +

Thai intestacy law sets out a fixed order of heirs — spouse, children, parents, siblings, and so on — and divides the estate according to that order. If your intentions differ from the statutory distribution, or if there are family members in other countries, a will allows you to make those arrangements explicit and enforceable.

How long does will drafting typically take? +

For a straightforward will, the process from initial conversation to notarized document usually runs two to three weeks. This allows time for an intake session, a draft for your review, any revisions, and the notarization appointment. More complex provisions may require additional time.

Can Rattana Counsel assist with estate matters outside Thailand? +

We are qualified to advise on Thai law. Where a matter involves assets or beneficiaries in other countries, we work alongside qualified counsel in those jurisdictions to ensure the Thai-side arrangements are properly coordinated. We can help identify and connect with appropriate overseas advisers where you do not already have them.

Are consultations conducted in English? +

Yes. Our team works comfortably in both English and Thai. All documents can be prepared in either or both languages according to your requirements and the applicable legal form.

What is the difference between the planning consultation and the comprehensive estate plan? +

The planning consultation is a focused session — typically one to two meetings — that surveys your situation and produces a written summary of options. It is suited for those who want a clear picture before deciding on next steps. The comprehensive plan is a full engagement involving document preparation, structure establishment, and ongoing consultation over several months, suited to estates of greater complexity.
