Property in Two Countries, Beneficiaries in Three

A Thai national with a condominium in Bangkok, a house in Chiang Rai, and bank accounts in the UK had adult children resident in Thailand, the UK, and Australia. No existing will. The client wanted to ensure that assets passed to beneficiaries without requiring lengthy court involvement in any of the three countries.

Our Work

We began with an extended intake covering all assets, beneficiaries, and the client's intentions. We prepared a Thai will covering the Thailand-sited property and coordinated with a UK solicitor to ensure the Thai arrangements were consistent with the UK estate plan. The comprehensive plan took just over three months from intake to execution.

Outcome

A coordinated estate plan with a notarized Thai will, aligned UK estate documents, and a clear written summary for the beneficiaries explaining what assets are where and what the succession process will require in each country.

Challenge

First Will for a Long-Term Expat Resident

A German national who had lived in Bangkok for nineteen years held a leasehold interest in a property, a vehicle, and savings in Thai bank accounts. He had a Thai partner and no children. He had assumed a foreign will would suffice for his Thai assets but had been told by a friend this was uncertain.

Our Work

We reviewed his existing German will with his German solicitor, confirmed which assets it covered and which it did not under Thai private international law, and drafted a Thai will covering the Thai-sited assets. The will was drafted in Thai and German, notarized in Bangkok, and completed within three weeks of the initial appointment.

Outcome

A notarized Thai will consistent with the existing German estate plan, with clear documentation of which instrument governs which assets. The client and his partner have copies; the originals are held securely.
